Where can I find the General Waiver?


General Waiver

  1. I consent to participate in The Event.
  2. I understand that Asian & Pacific Islander American Health Forum makes no representation concerning the safety of any car, bus, train or any other mode of transportation used during The Event. I also understand that Asian & Pacific Islander American Health Forum makes no representation concerning the safety of the equipment structure or any other part of the physical space where The Event will occur.
  3. I understand that Asian & Pacific Islander American Health Forum is not responsible for my personal property and that I assume full responsibility for lost or damaged personal property during The Event.
  4. Asian & Pacific Islander American Health Forum will take reasonable care to ensure the safety of all participants during The Event. However, participation in The Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. If I should become injured while participating in The Event, I authorize Asian & Pacific Islander American Health Forum to perform first aid and/or seek medical assistance, on my behalf, and I release Asian & Pacific Islander American Health Forum from responsibility for such decisions made in good faith.
  5. I, for myself and my personal representatives, heirs, and assigns, waive any claim of liability against and agree to hold harmless Asian & Pacific Islander American Health Forum from any and all actions, causes of action, judgments, costs, expenses, claims or demands, of every kind and character (including reasonable attorneys’ fees), arising from my participation in all or any part of The Event, except such liability or claim of liability as may result from gross negligence on the part of Asian & Pacific Islander American Health Forum.
  6. I expressly agree that the above personal property, waiver of liability, and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State and that if any portion is held invalid, it is agreed that the balance of the agreement will continue in full legal force and effect.
  7. I have read the previous paragraphs and I understand and appreciate these and other risks that are inherent in The Event. I assert that my participation is voluntary and that I knowingly assume all such risks. I also understand that I am giving up substantial rights, including my right to sue to Asian & Pacific Islander American Health Forum. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent the law allows. Wherever in this document the term Asian & Pacific Islander American Health Forum is used, the term shall include all of its trustees, officers, staff members, employees, and agents.

Publicity Release

  1. I give and grant to Asian & Pacific Islander American Health Forum, and its licensees, successors and assigns the absolute right and permission to use, in perpetuity, my name, portrait, photograph, video, performance and/or biographical materials, taken or made at any time whether taken or made by Asian & Pacific Islander American Health Forum or any other source (collectively, my “Likeness”), and if applicable, any accompanying spoken or written statements or expressions I make or have made (the “Statement”), either alone or accompanied by other material, in any manner and in any media, throughout the world for the purposes of education, advertising, promotion, marketing, and/or public relations, including but not limited to Asian & Pacific Islander American Health Forum’s on-line website and year-end-report.
  2. For any accompanying Statement: I agree that Asian & Pacific Islander American Health Forum will have the right to attribute the Statement (or statements in different words which have substantially the same meaning), which is an expression of my personal experience and belief, to me. I enter into this release, knowing that Asian & Pacific Islander American Health Forum is relying on the accuracy and truthfulness of the Statement I made or will make. In the event my opinion or beliefs change from the expressed belief in the Statement, I agree to inform Asian & Pacific Islander American Health Forum in writing. I agree that the Statement may be used in whole or in part and may be paraphrased, amplified, shortened, and/or put in conversational form to meet the requirements of copy, layout, and/or script provided the general sense is not changed.
  3. I hereby waive all my rights to inspect and approve any finished product in which my Likeness and Statement, if applicable is used, and agree that Asian & Pacific Islander American Health Forum owns all such materials and may copyright the same in its own name. If I should receive any print, negative, or other copy thereof, I shall not authorize its use by anyone else.
  4. I hereby release, discharge, and agree to hold harmless Asian & Pacific Islander American Health Forum (and its respective directors, oicers, employees, agents, affiliates and divisions) from any and all claims, actions, demands, damages, liabilities, costs, and expenses whatsoever which I now have or may hereafter ever have against all such persons or entities resulting from or arising out of the use of my Likeness and if applicable, the Statement, and/or any copyrightable material I may provide in accordance with the terms hereof.
  5. I warrant and represent that this release does not in any way conflict with any commitment on my part.
  6. Nothing herein shall constitute any obligation on the Asian & Pacific Islander American Health Forum to make any use of any of the rights set forth herein.




Is there a Code of Conduct?


Asian & Pacific Islander American Health Forum endeavors to make this Event free from all forms of discrimination, including sexual harassment and any other form of harassment (such as harassment based on race, color, ethnicity, religion, sex, gender, gender identity and expression, sexual orientation, national origin, disability, age, marital status, veteran status, uniformed service member status, pregnancy, parenthood, genetic information or characteristics [or those of a family member] or any other characteristic or status protected by law). Accordingly, any discrimination or harassment will not be tolerated and may result in a participant or volunteer being required to leave the Event, at their own expense.
